- All restaurant and retail operations are subject to change and no assurance is made that restaurants and retailers will be of the same nature as depicted or described. Restaurants and retailers may open in the project at different times and no assurance is made when any commercial user will open in the project, the hours of operation of any commercial user, or that a commercial user will ever open.
- Existing buildings, improvements and other structures within the immediate area may impact the view lines from and block, obstruct, shadow or otherwise affect certain residential units and parts of the development. The development is currently designed to be comprised of multiple towers, the construction of which will partially block, obstruct, shadow, and otherwise affect the natural light available to and the view lines from particular residential units and from parts of the development (the “Natural Light and Views”), which may currently be available to or visible from the residential units and the development. Additionally, because the development is located in an urban area that is subject to future development, demolition and construction of new buildings, improvements and other structures within the immediate area and within the view lines of any particular residential unit or of any part of the development may further block, obstruct, shadow or otherwise affect the Natural Light and Views. Natural Light and Views are not protected. KD Travis Block Holdco, LLC and its successors and assigns are not responsible for any losses, claims, demands, damages, costs, and expenses of whatever nature or kind relating to Natural Light and Views or the disruption, noise, commotion, and other unpleasant effects of nearby development or construction. KD Travis Block Holdco, LLC and its successors and assigns disclaim any and all representations about the current development plans in the area surrounding the development, and any prospective tenant disclaims any reliance on any such representations in connection with the rental of a residential unit in development.
- Prospective tenants acknowledge at the time prospective tenant occupies a residential unit, there may be outstanding construction and finishing work to be undertaken by the landlord to portions of the exterior and/or interior of the development which, pending the completion of all construction and finishing work in respect of the development, may: (i) require the continued placement and use of an exterior hoist (for hauling or conveying construction materials, workers and/or debris) that is temporarily anchored to the exterior façade of the development, immediately outside or near the residence unit, which in turn may obstruct prospective tenant’s view to the outside; and/or (ii) cause noise, vibration, dust and/or debris, which may be of concern to prospective tenant and may interfere with activities of the occupants of the residential unit. Prospective tenants will not interfere with the construction and completion of any portion of the development.
